The
Association has entered into a contact with Waste Connections, Inc. ("WCI") for trash pickup at a rate of $12 per month. Pursuant to the Association's agreement with WCI, Remington Place needs 85% participation for this rate. To start service

The following are the most relevant portions of the contract between the
Association and WCI:

WCI will provide one 90-gallon
residential cart to each residence.

WCI will provide, at a minimum, weekly refuse pickup for each
residence. Pickup is to be provided with
each residence being responsible for placing its cart(s) in their pickup area
prior to 6:00 a.m. on the designated pickup day.

WCI agrees to invoice each residence for its refuse service in
accordance with its normal billing procedures for other Wichita area households.
Each service location shall be responsible for its own bills.

This Agreement is for a
term of three years, commencing on May 1st, 2009 and ending April
30th, 2012. The agreement shall be renewed for successive three-year terms
without further action by the parties, but may be terminated at the end of any
three-year period by either of the parties hereto by not less than sixty day prior written notice (certified
mail).

The initial base monthly charge shall be $12 per month, $36 per quarter,
per residence for curbside service,
or $17 per month, $51 per quarter, per residence for carryout
service. These rates will be guaranteed
for the first year. In year two the rate per month cannot exceed $12.50 per
month, $37.50 per quarter and in year three the price cannot exceed $13.00 per
month, $39 per quarter. $17.50 per month
for carryout service in year two, $52.50 per quarter. In year three the rate per
month would be $18.00 per month and $54 per quarter.

Additional cart requests by individual homeowners shall be
billed at a rate of $7.00 per
month.

WCI reserves the right to adjust the rates hereunder based upon
increases in fuel, landfill costs, after the initial 1-year
term.

WCI may adjust the rates hereunder from time to time to reflect
the percentage increases in the local Consumer Price Index of Urban Wage Earners
and Clerical Workers (all items) published by the U.S. Department of Labor,
Bureau of Labor Statistics.

WCI will be responsible for
notifying each residence that waste material to be collected and disposed of by
WCI, pursuant to the Agreement, is solid waste generated by homeowners,
excluding radioactive, volatile, highly flammable, explosive, toxic or hazardous
material. The term “hazardous material”
shall include, but not be limited to, any amount of waste listed or
characterized as hazardous by the United States Environmental Protection Agency
or any state agency pursuant to the Resource Conservation and Recovery Act of
1976, as amended, or applicable state law.

WCI
will provide once a year a 40-yd open-top container for a community
clean up day for no charge, the Association, however will be responsible for the
disposal fees.
Those homeowners who have a
different trash service will likely incur a nominal termination fee if they
switch - however it is likely that the termination fee will be recouped in the first month through the new
discounted rate.
