SIDEWALK CONDEMNATION GUIDELINES
This policy sets forth guidelines to uniformly promote quality sidewalks in the city of Wichita (1) to enhance the neighborhood and homeowner property values, and (2) to ensure safe surface conditions for pedestrians.
1. A city sidewalk inspector shall investigate sidewalk complaints as soon as possible after receipt of complaint.
a. Complaints may be received in writing or by telephone. Oral complaints shall be recorded, noting caller's name, address, telephone number, location of sidewalk and condition of sidewalk.
b. Sidewalk inspector shall condemn potentially dangerous or inadequate sections of sidewalk on block complained about. Sidewalk on corner properties shall be condemned both north/south and east/west.
2. Sections of sidewalk which are inadequate and/or potentially dangerous to pedestrian traffic shall be condemned.
3. Sections of sidewalk with simple tight cracks shall not be condemned unless those sections are adjacent to condemned sections. Sections of sidewalk with multiple cracks or cracks wide enough to grow grass shall be replaced.
4. Sections of sidewalk that are raised or have sunken 1" or more create a trip hazard and shall be leveled or replaced.
5. Sections of sidewalk showing excessive signs of spalling shall be replaced.
6. Sections of sidewalk ponding water are potentially dangerous and shall be condemned: property owner may either raise the sidewalk or lower the parking.
7. Sections of sidewalk with excessive cross-slope (more that 1/2" in 12") or sloped away from the street shall be replaced.
8. The corner sidewalk section and any sections in the inner area on the corner of an intersection bounded by the projected property lines and the curb shall be the City's responsibility.
9. Sidewalk replacement shall be done only by a licensed cement contractor after obtaining a City permit to do the work. Leveling may be done by the property owner without a permit. If the property owner elects to have the repairs done privately, the City must be notified to inspect the work to remove it from the repair list.
10. Thirty (30) day extensions may be granted after a permit has been issued to a licensed cement contractor, but the work must be done within a reasonable time period after issuance of the permit.
