Section 2.03.      Description of Common Area. The Common Area in the [Villas and Remington Place] to be conveyed to the Association are identified as follows:

Reserves A, C, D, E, F, G, I, J, K and M in Remington Addition

Reserve A in Remington Second

Reserves D, E and F in Remington Third

Reserve A in Remington Fourth

subject to redefinition as permitted herein, shall be used and maintained in compliance with the respective plats creating such Reserves.

        The Common Area may be used for recreation or other uses, subject to plat restrictions, for the benefit of the Members as may be determined by the Association. Recreational facilities, including, but not limited to, grills and fireplaces, playground equipment, and similar items, may be constructed in the Common Area, subject to plat restrictions and only by the Association. All Members in good standing, their families, and guests accompanying said Members shall have equal access to the Common Area and all facilities located thereon, if any, subject to rules and regulations established by the Association, including the right to place limitations on the number of guests and the right to limit or exclude Members, their families, and their guests if the Members owning the Lot in which they reside are in default in the payment of assessments to the Association or in the performance of any other obligation required by this Declaration. The Association shall have the right to suspend the rights of any Member in connection with such member's use of the Common Area for any period during which any assessment remains unpaid and for any period, not to exceed thirty (30) days, for any infraction of its published rules and regulations.

        There is hereby created an easement for access applicable to the portion of any reserve that is conveyed as appurtenant to a separate Lot, for purposes of repair and maintenance thereof by the Association. Such easement shall not be construed to grant any Member of either association a right of access over or across any Lot for the use or enjoyment of a reserve.
