2.01 "Association." Association means the Remington Place
Master Owners' Association, its successors and assigns. 2.02
"Common Area." Common Area means all real and personal
property commonly owned by the Association for the common use and
enjoyment of the Owners.
2.03 "Declarant." Declarant means S&P Development, a
Kansas J oint
Venture, and its successors and assigns.
2.04
"Lot." Lot means a lot as set forth in the recorded plat of
the Remington Addition, Remington Second, Remington Third and
Remington Fourth that is subjected to the Remington Covenants;
provided that where property has been attached or detached from any
Lot, the enlarged Lots and/or the diminished Lots shall be deemed to
be a "Lot"; and provided further, however, that two or more
whole Lots that are combined into a single home site shall be deemed
to be one "Lot" for the purpose of computing voting rights
and liability for Common Area assessments hereunder, but shall be
treated as two or more Lots, as the case may be, for the purpose of
paying for Association-provided Lot maintenance.
2.05
"Member." Member means every person or entity who or which
is a record Owner of a fee or undivided fee interest in any Villas
Lot or Remington Lot, but not including any Owners who have sold
their interest under executory contract. During such time as such
contract is in force, the contract vendee shall be considered to be
the Member. When more than one person holds an interest in any Lot,
all such persons shall be Members. Unless expressly stated to the
contrary, all references herein and in the Remington Covenants to
"Members" includes owners of Remington Lots and Villas
Lots.
2.06
"Owner." Owner means the record owner, whether one or more
persons or entities, of the fee simple title to any Lot which is a
part of the Properties, including contract purchasers, but excluding
those having such interest merely as security for the performance of
an obligation.
2.07
"Properties." Properties means that certain real property
commonly known as Remington Place, an addition to Wichita, Sedgwick
County, Kansas, Remington Place Second, an addition to Wichita,
Sedgwick County, Kansas, Remington Place Third, an addition to
Wichita, Sedgwick County, Kansas, and Remington Place Fourth, an
addition to Wichita, Sedgwick County, Kansas, and such additional
land as may hereafter be brought within the jurisdiction of the
Association.
2.08
"Remington Covenants." Remington Covenants means the
Declaration of Covenants, Conditions, and Restrictions of Remington
Place dated December 10, 2001, as amended by the First Amendment to
Declaration of Covenants, Conditions, and Restrictions of Remington
Place dated November 21, 2006 applicable to the Properties recorded
now or hereafter in the Office of the Register of Deeds of Sedgwick
County, Kansas.
2.09 "Remington Lots." Remington Lots mean Lots 12 through
16, inclusive in Block 3; Lots 24 through 31, inclusive, in Block 6
and Lots 19 through 28, inclusive, in Block 7, in Remington Place, an
Addition to Wichita, Sedgwick County, Kansas, Lots 1 7 through 22,
inclusive, Block 3 in Remington Addition; Lot 14 in Block 4 in
Remington Addition, Lots 1 through 18, inclusive, in Block 7 in
Remington Addition; Reserves J,
K and M in Remington
Addition; Lots 12, 13 and 36 in Block 1 in Remington Third. The
neighborhood comprised of the Remington Lots is sometimes referred to
herein as the "Remington Place. "
2.10 "Villas Lots." Villas Lots mean the lots in Remington Addition, Remington Second Addition, Remington Third Addition and Remington Fourth Addition that are not Remington Lots. The neighborhood comprised of the Villas Lots is sometimes referred to herein as "the Villas. " |
